Thomas Michael Bailey, 32, of Warsaw has been arrested for violating a court-ordered bond condition after being released on his own recognizance.

Bailey, who is now being held without bail, is ordered to appear at 10:30 a.m. July 5 at 10:30 a.m. for a plea or trial-setting hearing.

Bailey faces 14 felonies including: first-degree rape or attempted rape of a victim less than 12 years of age; four counts of first-degree sodomy or attempted sodomy of a victim less than 12 years old; tampering with a witness in a felony; three counts of person with serious infectious/ communicable disease knowingly exposing another to disease, and five counts of incest.

According to courts. mo.gov, on June 2 a plea or trial-setting hearing was scheduled, but not held. Prosecuting Attorney Camille Johnston and Public Defender Karen Klingbeil agreed to a change in Bailey’s bond and he was released on his own recognizance with bond conditions.

On June 6, a report was filed to Ray County Court Division informing the court that Bailey had violated a condition of his release. The next day, Ray County’s Eighth Judicial Circuit Court Judge Kevin L Walden issued a warrant for his arrest. “It appears to the Court that there has been a breach of one or more conditions of release and the defendant has previously been arrested, informed of the conditions set and imposed and advised that the conditions of release may be revoked… Conditions of release are revoked. It is ordered that a warrant shall be issued for the arrest of the defendant. Conditions of release

denied pending an appearance,” the report read.

Ray County Sheriff Scott Childers advised, on June 12 Greene County Sheriff’s Office made the initial arrest of Bailey based on the warrant and Ray County Sheriff’s Office extradited, placing him into their custody.

At 2 p.m. on August 31, 2021, Ray County Sheriff’s Detective Mark R. Crawford observed a forensic interview of a juvenile victim by Tiffany Clark of Synergy Services regarding the case.

“It should be noted that upon intake to Ray County Sheriff’s Office Detention, T. Bailey, on the Health Questionnaire, did not make any yes or no declaration for the exposure to communicable diseases question. T. Bailey did circle, as an option for the exposure question, HIV. (An acquaintance of Bailey) did confirm that T. Bailey has been AIDS-positive

for at least eight years,” Crawford said in the probable cause statement.

“T. Bailey attempted, on several occasions, to intimidate the juvenile into not speaking of these assaults. Once, T. Bailey attempted to intimidate the juvenile in front of Ray County deputies,” the probable cause statement read. “Based on the information received, I believe probable cause exists to charge Thomas Michael Bailey with statutory rape, statutory sodomy, child molestation, tampering with a victim and recklessly risk infection of another with HIV when the actor is knowingly infected with HIV. I believe Thomas Bailey is a danger to the community and a flight risk due to the nature of the crime.”
