Man rearrested, sodomy

A failure to abide warrant was issued and served for a man facing two felony charges after a mistake was made regarding his bond. Former Richmond resident Juan-David Gutierrez, 31, is charged with first-degree sodomy or attempted sodomy and second- degree sodomy. When the original warrant was issued for these charges on April 2, Gutierrez’s bond was placed at $25,000 cash or licensed surety. After Eighth Judicial Circuit Court Judge Joseph D. McGaugh was assigned to the case on April 8, on his own motion, McGaugh increased the bond amount to $100,000 cash only. Gutierrez was being held at the Caldwell County Detention Center until McGaugh ordered a writ of habeas corpus to have him brought to Ray County Jail for his preliminary hearing. Unexpectedly, a mistake in the bond was then made and led to Gutierrez’s release on the $25,000 surety bond.
