Public defender denied in sodomy case

A man facing two felonies involving alleged sodomy has been denied a public defender. Juan-David Gutierrez, 32, is charged with first-degree sodomy or attempted sodomy and second-degree sodomy. Gutierrez appeared on Nov. 25 for a trial- setting hearing, represented by his private attorney, Michael S. Santschi. Gutierrez previously submitted an application for a public defender but a notice of denial was filed by Missouri State Public Defender Tiffany M. Leuty earlier this week with Ray County Court. “The applicant has been found to not be indigent,” wrote Leuty. “Should this court take up the matter of this applicant’s indigence, this office requests advanced notice of any such hearing. Any such person claiming indigency shall file with the court an affidavit which shall contain the factual information required by the commission under rules which may be established by the commission in determining indigency.” As of press time, Santschi is still listed as Gutierrez’s attorney. …
