In re: Mark Emry and Loralei A. Emry, husband and wife

TRUSTEE’S SALE–Default having been made in the payment of the promissory note described in and secured by a certain deed of trust executed by Mark Emry and Loralei A. Emry, husband and wife, dated June 30, 1999 and recorded July 6, 1999, in Book 892, Page 196, as Document No. 023726, in the Office of the Recorder of Deeds of the County of Ray, State of Missouri, the undersigned successor trustee at the request of the legal holder of said note, will on Friday, November 4, 2011, between the hours of 9:00 a.m. and 5:00 p.m. (At the specific time of 1:30 p.m.) at the South Front door of the Ray County Courthouse, in the City of Richmond, State of Missouri, sell at public vendue to the highest bidder for cash, the following real estate described in said deed of trust and situated in the County of Ray, State of Missouri, to wit:

A part of the Southwest Quarter of the Northeast Quarter of Section 35, Township 54 North, Range 29 West of the Fifth Principal Meridian, Ray County, Missouri, and more particularly described as follows: Commencing at the quarter corner center of said Section 35; thence North 00 degrees, 20 minutes, 58 seconds West along the North/South centerline of said Section 35, a distance of 45.18 feet (by survey) 35 feet (by deed) to a point on the North right-of-way line of Missouri State, Ray County, Route “D”; thence North 89 degrees, 35 minutes, 40 seconds East (by survey) South 89 degrees, 57 minutes East (by deed) along said North right-of-way line, a distance of 747.50 feet to the point of beginning of the herein-described tract; thence North 00 degrees, 35 minutes, 00 seconds East, a distance of 707.09 feet; thence North 89 degrees, 35 minutes, 40 seconds parallel to said North right-of-way line of Route “D”, a distance of 176.83 feet; thence South 00 degrees, 43 minutes, 35 seconds East, a distance of 707.00 feet to a point on said North right-of-way line of Route “D”; thence South 89 degrees, 35 minutes, 40 seconds West (by survey) North 89 degrees, 57 minutes West (by deed) a distance of 193.00 feet to a point of beginning of tract herein described. Subject to easements, restrictions and reservations of records, if any.
