Ray County Prosecutors have dropped vehicular assault charges against an Orrick teen and have now charged him with involuntary manslaughter.
Cody Kolosick is now charged with involuntary manslaughter and driving while intoxicated.
The charge is a class B felony because Kolosick’s blood alcohol content was above 0.18 percent, according to the charges filed in the court records.
The charges allege that Kolosick was driving a Chevrolet vehicle and struck Todd Dickens. Dickens was riding in a wheelchair on the way home from one of his children’s baseball games on June 11, 2008.
According to court records, Kolosick was cited by Orrick Police for minor in possession in April of 2008.
Dickens sustained life-threatening injuries, and later died on Sept. 17, 2008.
Dickens had filed a civil lawsuit against Kolosick before his passing that has since been picked up by his family.
Kolosick’s next court appearance is Feb. 3. If convicted he could face five to 15 years in prison.
